1. Provider

2. Scope

These Terms & Conditions govern all contracts for coaching services, consulting, programs, digital content and other services provided to consumers and business clients.

3. Services

(1) The provider delivers evidence-based fitness & health coaching (e.g., training & nutrition plans, weekly calls, WhatsApp support, analysis of client-provided blood work, access to a training app).
(2) No medical treatment: Coaching is not medical care. It does not replace diagnosis or therapy by licensed physicians. All medical decisions remain the client’s responsibility.
(3) Scope, duration and price are defined in the respective product/offer description.

4. Conclusion of contract

(1) Displayed offers are non-binding.
(2) A contract is concluded when the client completes a booking/checkout (e.g., via Stripe/Calendly/website) and the provider confirms or starts delivering the service.
(3) The contract text is not stored in a publicly accessible way; order details and these Terms will be provided by email.

5. Prices and payment

(1) Prices are stated in EUR and include statutory VAT where applicable.
(2) Payment is due immediately via the methods offered on the website (e.g., Stripe, SEPA, Sofort/Klarna).
(3) In case of payment default, the provider may suspend services until payment is made.

6. Term, appointments, rescheduling

(1) Unless agreed otherwise, the respective program/package term applies (e.g., 12 weeks).
(2) Cancellations: Rescheduling is possible up to 24 hours in advance; later cancellations or no-shows count as completed sessions.
(3) Unused services within the term expire unless non-use is attributable to the provider.

7. Client duties

(1) The client provides complete and truthful information regarding health status, medication and contraindications.
(2) Implementation of recommendations (training, nutrition, lifestyle) is the client’s responsibility.

8. Results / no guarantee

(1) No specific result is owed. Outcomes depend on the client’s baseline and execution.
(2) The client provides honest and regular progress data (e.g., circumference, weight, strength).

9. Digital content & usage rights

(1) For documents, plans and videos provided, the client receives a simple, non-transferable, non-sublicensable right of use for the contract term.
(2) Sharing, publishing or commercial use without permission is prohibited.

10. Liability

(1) The provider is liable without limitation for intent and gross negligence as well as for injury to life, body or health.
(2) For simple negligence, liability exists only for breach of a material contractual obligation (cardinal duty) and is limited to the typical, foreseeable damage at the time of contract.
(3) Liability under product liability law remains unaffected.

11. Data protection

The Privacy Policy on the website applies. Communication channels such as email/WhatsApp are used only with consent.

12. Right of withdrawal for consumers

(1) Consumers have a statutory 14-day right of withdrawal; details and the model form are set out in the Right of Withdrawal at /withdrawal.
(2) Start of performance before expiry of the period: If the client requests that services begin before the end of the withdrawal period, the right of withdrawal expires upon full performance; in case of partial performance, reasonable compensation may be payable.

13. Consumer dispute resolution / ODR

The provider is not obliged and not willing to participate in dispute resolution before a consumer arbitration board. The EU Online Dispute Resolution platform (ODR) is available at ec.europa.eu/consumers/odr.

14. Governing law, contract language

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection at the client’s residence remains unaffected.
(2) Contract language is German; this English version is provided for convenience. In case of discrepancies, the German version prevails.

15. Final provisions

(1) Changes/amendments require text form.
(2) If any provision is invalid, the remainder of the contract remains effective.
